2003 530i - Oil separator/Seized Engine/Service bulletin...

    A week ago my 03 530i suffered a seized engine/billowing clouds of white smoke out the exhaust after about 3 minutes from a cold start in a cold outdoor garage. :(

    Had it towed to my trusted service shop - which is not Tulley BMW here in Nashua NH. They promptly diagnosed it as a failure of the oil separator (all the oil was at the top of the engine - none below). Found and installed an engine ($5800). We're now trying to burn off all the oil that's in the exhaust system...

    Discovered that there is a Service Bulletin for all M54 Engine models (at http://www.bimmerfest.com/forums/attachment.php?attachmentid=210092&d=1259409341 ). :eek: Note that this states that "complete engine failure" is a possible outcome. There is a kit that fixes the problem for the M54 Engine.

    BMW USA was less than helpful - but stated that had I taken it to the dealer they "might have been able to do something". I find this position beyond absurd -- since in order to know that the cause of the problem was this design defect, the engine has to be in the dis-assembly process.

    I'd strongly suggest folks that live in the cold with M54's get this kit installed.

    Given this is a known failure with an engineered correction, I strongly believe BMW had a duty to let the owners know about this.

    I've filed a complaint with the NTSB, will file one with NH's Consumer Protection agency, alerted Consumer reports, and am considering legal action.

    Any other thoughts?

    Sorry to hear about the engine disaster. You would think BMW would have notified all owners of this known problem. I'm no lawyer but I think you have a strong case for compensation.

    I'm not sure if you mean you filed a complaint with the NTSB or nhtsa.gov? NHTSA is the agency responsible for auto safety and defects.

    Just out of curiousity, did you ever check to see what Service Bulletins were available for your car when you got it, or through the course of ownership? All BMWs have their own little problems, the E39 no exception. I personally don't think you'll get a dime from BMW as they'll probably end up saying you didn't do your part to check applicable services that must be performed on your car. That, and the fact that the car is out of warranty doesn't help either. Hopefully they will offer some kind of goodwill compensation, but don't expect it.

    I do not believe it is the manfacturer's responsibility to tell all their customers with certain vehicles about a potential problem. Recalls are a different story.



    What happened really sucks, I agree. But another thing; since when did an M54 cost over 5 grand? I think you got shafted on that engine.

    I love the rationalization... "all BMWs have their own LITTLE PROBLEMS". Right. I'd call a complete engine failure a bit more than a "little problem". I'm sure it's the customers fault they didn't scour all information sources to find out that their car has a serious design defect that BMW has confirmed. :(

    So when a car maker has a design defect that can cause a disaster be it a crash or a fatal engine failure and they know about the problem and they've issued a corrective action for the problem, which is a documented defect, they don't have any obligation to inform the customer until after the failure/accident/injury/damage occurs? I think not. That is precisely why NHTSA.gov exists and why companies who fail to notify customers of serious defects and correct them properly in a timely fashion, get sued and pay out hundreds of millions in class action lawsuits in addition to individual lawsuit claims. If it were me, I'd do an online search for this issue and find a law firm with expertise in this matter.

    That's a direct quote from the BMW USA customer relations rep.

    Interesting question: Does anyone know of a reliable way to look at BMW service bulletins for consumers/owners?

    In no way am I saying COMLETE ENGINE FAILURE is a "little problem". What I am saying is that since all BMWs have some kind of issues with each model, that someone should check into their car's history and SB's to see if any applicable fixes apply. In this case, there just happens to be some sort of potential extreme failure that may occur, and in this case it actually happened. Going around telling everyone that your engine may seize is like making a world-wide announcement that you could potentially DIE from choking on your cereal. It's not something that WILL happen or something that will happen A LOT, just something that *could* happen, and that one should take *care* when eating cereal instead of hopping around panicking, never to eat cereal again. Then along comes the person who chokes on the cereal because he never thought it was possible and didn't bother paying attention to it.



    I agree Dennis, there should be a much easier way to check for these bulletins.

    How hard can it be to notify JUST the right owners?

    I'm guessing BMW actually uses those newfangled computers to keep lists of who owns what models and their mailing addresses.

    So maybe it takes a couple of hours to put a list and a letter together on problems like this and hit the "send" button.

    Dose not seem like a huge burden give what we pay them for these machines.

    how many miles are on the car? If you have less than 100k on it I would really be asking BMWNA to do something for you. Even if it's for them to cover the cost of the engine and you pay the labor. In that scenario, they would require you to pay a dealer to install the engine. That is fair, as they obviously need to know that their engine is going to be installed properly. This is a well known issue and is not just on the M54 engine. This is common on the M62 V8 as well. Remember that if you are a rabid dog looking for a meal while talking to BMW they will tell you to pound salt. You have to stay calm and just maintain your position that this has been a known issue and that your case is pretty extreme. We replace these valves all the time, but rarely does it actually result in engine failure like this. Just be respectful to whomever you talk with and if they can't help you nicely ask to speak to their superior. I would also suggest contacting the service manager at the dealer where you get the car serviced. They can really get the process moving faster, as all BMWNA does is call him after talking to you, then evaluate. The service manager can call the warranty rep directly and usually have an answer in a day or two. Hopefully you have a relationship with a dealer, as that should help your cause. If you don't, things are not looking too good for you as that's big in their minds when it comes to goodwill gestures. The two biggest factors are where you bought the car and if you are a loyal service client. If you bought the car from a private seller and have never been to a dealer for service, they probably aren't going to participate. You can't really blame them for that. You have the option to have an independent work on your car, but this is one of the risks you take by doing so.

    Do you take a lot of short trips, meaning under 8-10 miles? Taking short trips means you are going to get excessive condensation buildup in the crankcase ventilation system. The condensation will build up as it will never get "burned" off. You need to get the engine all the way up to temp and drive it for a while in order to "burn" that moisture out of there. That can take 15-20 minutes of driving especially in colder temps. Also as a side note, letting the car sit and idle is not getting the car up to temp properly. This can lead to other issues, plus fluids that aren't "in motion" while the car is idling will still not be warmed up (ie trans/diff fluid).

    is the car stored inside a heated garage?

    If not, the condensation mentioned above will freeze. When water freezes in confined spaces, things break when the ice expands. This is ultimately what probably happened to your engine.

    You mean just like Toyota/Lexus called 5.5 million people to tell them they are driving a potential death trap? There you have a case where peoples lives were/are in danger and they failed to notify them. Some of those cars having been on the road for over 4 years now with reports of this problem!!! If you knew how many service bulletins there were for every car, particularly BMW, you would understand why you are not notified about every one. Actually, here you go...

    Now that I'm reading this again I see that you already had the engine replaced. I'm afraid your wasting you're time looking for compensation at this point. BMW is never going to help you with this since it's already repaired. You can't expect them to take your independant shops word that it needed an engine. They would have had to determine that on their own. I hope the new engine has the cold weather kit installed already!

    The old engine is probably still available for inspection. In addition a professional could most definitely confirm the origin of failure.

    Ok, so let's assume BMW ships 1.5M cars a year and has for 20 years - and that each year they send a quarterly update to each owner impacted by a SB that has potentially serious impacts. Maximum of 120M pieces of mail. Push a button and they just "happen". BMW knows the stuff in each car and can easily remind each recipient. Assign a stupidly high cost to each mailing of $2 - so $8 a year total cost per vehicle.

    Let's assume BMW offered to do this for out-of-warranty customers for $20 a year via email or $25 via snail mail. Wouldn't any self-respecting BMWCCA member subscribe? Anyone who spends $40K-$100K on a car and wants to keep it a while (even those dumb enough to not join BMWCCA!)?

    If I got a notice that included the info on this issue, I'd have paid to have the mods done per the SB without blinking.

    Do the math - this would put $ on BMW's bottom line (directly and by causing the right kits to get placed in the right cars) and improve both the longevity of their vehicles and their resale value.

    IMO BMW is losing credibility when they have major V-8 engine failures, subframe fractures, significant auto trans failures and four continuous years of HPFP failures which they basically deny exist until they get sued. Customer loyalty only goes so far in my opinion.

    All auto makers have product issues from time to time. How they handle those problems determines if they lose customers or build brand loyalty.

    BMW, Toyota, Ford, anyone ... the first automaker to do this will have customers lined up around the block walking away from their dealerships, never to return.

    Take it from an engineer, the average person is woefully ignorant of--or unsympathetic to--the fact that engineering is a discipline of failure mitigation and continuous improvement. Send out dozens of SIB's a year and for every person like you or me who says, "wow, look how passionate they are about improving their product," there will be fifty who say, "wow, these guys are building utter crap, I'm buying a <Tight-Lipped Competitor>."

    Being careful about releasing technical information to a non-technical public is, sadly, a wise precaution in a litigation-happy society.

    Tischer BMW's online catalog lists an M54 at over $7500 MSRP; their price, about $6K plus $500 core charge. $5800 seems like a decent deal.

    Tischer BMW is a dealer. The dealer is the wrong place to buy an engine. For that much money, he could have bought an M54 AND a really nice rust-free E30 to go along with it.

    I've looked and have found at least 3 M54's for less than that, a few on eBay and some for sale privately. Junk yards can also provide one for a lot less.
